Codeage LLC ("Codeage," "we," "us," or "our") is the controller of personal information collected through https://www.codeage.com, the Codeage blog at https://blog.codeage.com, and all other URLs on the codeage.com domain (collectively, the "Site"). This Privacy Policy describes how we collect, use, share, and protect your personal information, and the rights and choices available to you. The specific rights and choices available to you, and the procedures to exercise them, may vary depending on your jurisdiction of residence and applicable law.

 

1. INFORMATION WE COLLECT

When you visit the Site, place an order, create an account, contact us, or interact with our communications and features, we collect the following categories of personal information.

Device and Browsing Information. Information about your device and how you interact with the Site, including IP address, browser type, operating system, time zone, device identifiers, referring URLs, pages viewed, search terms, time spent on the Site, and information collected through cookies, log files, pixels, tags, and similar technologies.

Order Information. When you make or attempt to make a purchase, we collect your name, billing address, shipping address, email address, telephone number, and payment information (processed by our payment service providers).

Account Information. If you create an account, we collect your name, email address, password, communication preferences, order history, and other information you choose to provide.

Communication Information. When you contact us by email, telephone, SMS, WhatsApp, or live chat, we collect the content of those communications and related metadata.

Survey, Review, and Optional Content. When you respond to a survey, submit a review, answer a question, upload a photo, or otherwise provide content to us, we collect that content and associated information, including your wellness preferences and product interests where voluntarily submitted.

Loyalty Program Information. If you participate in our rewards program, we collect information about your participation, points balance, redemption activity, and related preferences.

Subscription Information. If you sign up for a Subscribe & Save subscription, we collect information related to your subscription cadence, product selection, billing schedule, and modifications.

Wholesale and Distribution Inquiries. When you submit an inquiry through our distribution intake process, we collect the information you provide about your organization, markets, and contact details. This intake is AI-assisted and is described further in Section 4 below.

We refer to all of the above collectively as "Personal Information."

 

2. HOW WE USE PERSONAL INFORMATION

We use Personal Information for the following purposes:

- To process, fulfill, and ship your orders, including arranging payment, providing invoices and confirmations, and managing returns and refunds;

- To manage your account, including authentication, security, and account preferences;

- To communicate with you about your orders, account, inquiries, and customer support requests;

- To provide and manage the Codeage rewards program and any active subscriptions;

- To send you marketing communications about Codeage Products and Services, where permitted by law and consistent with your preferences;

- To personalize your experience, including by displaying relevant Products and content;

- To detect, prevent, and address fraud, security incidents, and other harmful or unlawful activity;

- To improve our Site, Products, Services, and customer experience, including through analytics;

- To measure the performance of our marketing and advertising;

- To comply with applicable laws, regulations, and legal process;

- To enforce our Terms & Conditions and protect our rights, property, and the safety of others;

- For other purposes disclosed at the time the information is collected.

 

3. HOW WE SHARE PERSONAL INFORMATION

We share Personal Information with the following categories of recipients:

Service Providers. We engage third-party service providers to perform functions on our behalf, including e-commerce platform and checkout, payment processing, order fulfillment and shipping, analytics, advertising and marketing, customer support and live chat, review collection and display, loyalty program administration, subscription management, email and SMS messaging, and infrastructure and hosting. These providers may access Personal Information only as needed to perform their functions and are contractually required to handle Personal Information consistent with this Privacy Policy.

Advertising and Analytics Partners. Certain advertising and analytics activities may be considered "sharing" or "sale" of personal information under some US state privacy laws. You may opt out at any time through the "Your Privacy Choices" link in our Site footer, as further described in Section 7 below.

E-commerce and Checkout. Our online store is powered by Shopify; please review Shopify's privacy practices at https://www.shopify.com/legal/privacy.

Live Chat. Our on-Site chat is powered by Gorgias and may be handled by an automated system, a human team member, or both, in accordance with the disclosure presented when you initiate the chat. Live chat is intended for general customer support and does not provide medical, healthcare, diagnostic, or therapeutic advice. Information you provide in chat about your wellness preferences or product interests is processed as described in this Privacy Policy. You should not rely on chat responses as a substitute for advice from a qualified healthcare professional. Chat transcripts are retained as reasonably necessary for support, legal, security, and compliance purposes. You may request deletion of your chat transcripts by contacting [email protected]. We will honor deletion requests as required by applicable law, subject to retention obligations and exceptions permitted under that law.

Legal and Safety. We may disclose Personal Information when we believe in good faith that disclosure is necessary to comply with applicable law, respond to lawful requests from public authorities, enforce our agreements, protect our rights or property, or protect the rights, property, or safety of others.

Corporate Transactions. In connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, Personal Information may be transferred as part of that transaction, subject to applicable law.

4. AI-ASSISTED FEATURES

Codeage may offer AI-assisted features from time to time as part of the Site and Services. AI-assisted features are intended for general informational, support, or operational purposes and do not provide medical, healthcare, diagnostic, therapeutic, legal, or other professional advice. Outputs from AI-assisted features may be incomplete or inaccurate. You should not rely solely on AI-assisted outputs in making decisions about your health or wellness; consult a qualified healthcare professional before starting, changing, or stopping any supplement regimen. Codeage does not warrant the accuracy, completeness, or suitability of any AI-assisted output. Where required by applicable law, the AI nature of a feature will be disclosed at the point of interaction.

If you submit an inquiry through our wholesale or distribution intake process, your submission may be processed by an AI-assisted intake tool to qualify and prepare the inquiry for review by our sales team. This intake tool is intended for wholesale and distribution inquiries only and is not used for consumer customer service. Audio submissions are not retained as recordings; only the processed information used to evaluate the inquiry is forwarded to our team.

 

5. COOKIES AND TRACKING TECHNOLOGIES

We and our service providers use cookies, pixels, tags, web beacons, log files, and similar technologies to operate the Site, remember your preferences, analyze how the Site is used, measure the performance of our marketing, and deliver tailored content and advertising.

You can manage cookies through your browser settings and through the "Your Privacy Choices" link in our Site footer. Disabling certain cookies may affect the functionality of the Site.

We do not alter our data collection or use practices in response to Do Not Track signals from your browser. We honor Global Privacy Control signals where required by applicable law.

6. EMAIL AND SMS COMMUNICATIONS

Email. You may receive marketing emails from us where you have provided your email address and not opted out. You can unsubscribe at any time by clicking the "Unsubscribe" link in any marketing email or by contacting [email protected].

SMS and Text Messaging. When you opt in to receive text messages from Codeage, we collect your mobile phone number solely to send you the messages you have requested. We do not sell, rent, or share your mobile phone number or SMS/text messaging data with third parties or affiliates for their marketing or promotional purposes. Your mobile information is used only to send service-related messages, transactional updates, and marketing messages you have consented to receive from Codeage.

Consent to receive SMS messages is not a condition of purchasing any Product or Service from Codeage. SMS opt-in is a separate and distinct consent from any other agreement with Codeage. By subscribing to text notifications, you agree to receive recurring automated marketing messages at the phone number provided. Message frequency varies. Message and data rates may apply. 7. YOUR PRIVACY CHOICES

You have the following choices regarding your Personal Information. The specific rights and procedures available to you may vary depending on your jurisdiction of residence and applicable law.

Opt out of "sale" or "sharing" of Personal Information. You can opt out of the sale or sharing of your Personal Information for cross-context behavioral advertising by clicking the "Your Privacy Choices" link in our Site footer.

Opt out of marketing communications. You can unsubscribe from marketing emails by clicking "Unsubscribe" in any email, or from SMS marketing by replying STOP.

Manage cookies and tracking. You can manage cookies through your browser settings and through the "Your Privacy Choices" link.

8. US STATE PRIVACY RIGHTS

California "Shine the Light". California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure of Personal Information to third parties for direct marketing purposes. We do not share Personal Information with third parties for the third parties' own direct marketing purposes without your consent.

Nevada Residents. Nevada residents have the right to opt out of the sale of certain Personal Information to third parties who intend to license or sell that information. We do not currently sell Personal Information as defined under Nevada Revised Statutes Chapter 603A. 9. CANADA

If you are a resident of Canada, we process your Personal Information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws, including Quebec's Act respecting the protection of personal information in the private sector ("Law 25").

You have the right to access, correct, and request deletion of your Personal Information. You also have the right to withdraw consent to certain processing, subject to legal and contractual restrictions. Codeage may transfer Personal Information of Canadian residents to the United States and other jurisdictions for processing. Where required by law, we implement appropriate safeguards for such transfers.

10. EUROPEAN ECONOMIC AREA AND UNITED KINGDOM

Codeage primarily serves customers in the United States and Canada. If you access the Site from the European Economic Area or the United Kingdom, please note that your Personal Information may be transferred to and processed in the United States, where data protection laws differ from those in your jurisdiction.

To the extent applicable, you have rights under the EU General Data Protection Regulation and UK General Data Protection Regulation, including rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing. 11. LOYALTY PROGRAM AND FINANCIAL INCENTIVE NOTICE

Codeage offers a rewards program through which members may receive points, discounts, early access, or other benefits in exchange for participation. Participation in the rewards program involves the collection of Personal Information, including your name, email address, purchase history, and program activity.

Participation in the rewards program is voluntary. You may decline to participate or withdraw at any time by contacting [email protected]. The value of the rewards program to Codeage is reasonably related to the value of the Personal Information collected, taking into account the cost of administering the program and the benefits provided to members.

 

12. DATA RETENTION

We retain Personal Information as reasonably necessary to fulfill the purposes for which it was collected, including to provide our Services, comply with our legal, accounting, tax, and reporting obligations, prevent fraud, resolve disputes, maintain security, and enforce our agreements.

General retention guidance includes:

- Order and transactional data: retained for at least seven (7) years in accordance with tax, accounting, and warranty obligations;

- Account data: retained while your account is active and for a reasonable period thereafter;

- Marketing data: retained until you opt out, with reasonable time thereafter to process the opt-out;

- Customer support records and chat transcripts: retained as reasonably necessary for support, legal, security, and compliance purposes. Deletion requests will be honored as required by applicable law, subject to retention obligations and exceptions permitted under that law;

- Device and browsing data: retained for the period set by the relevant cookie or analytics tool;

- Wholesale and distribution inquiry data: retained for the duration of the inquiry process and any resulting relationship.

Actual retention periods may vary based on operational, legal, security, fraud prevention, or compliance requirements, and may be extended where necessary, including in the event of a legal hold, audit, or pending investigation. Where legally required, we anonymize or delete Personal Information after the applicable retention period expires.

 

13. SECURITY

We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, disclosure, alteration, and destruction. However, no method of internet transmission, electronic storage, or other security measure is completely secure, and we cannot and do not guarantee the absolute security of Personal Information. You provide Personal Information to us at your own risk.

 

14. CHILDREN'S PRIVACY

The Site and Services are intended for individuals 18 years of age and older. We do not knowingly collect Personal Information from children under 13, and we do not knowingly market to or solicit information from individuals under 18.

If we learn that we have collected Personal Information from a child under 13 without verifiable parental consent, we will delete that information. If you believe we may have collected information from a child under 13, please contact us at [email protected] so we can investigate and take appropriate action.

 

15. CHANGES TO THIS PRIVACY POLICY

Codeage reserves the right to update or modify this Privacy Policy at any time, in our sole discretion. Updates become effective when posted to the Site. Your continued use of the Site or Services after an update constitutes your acceptance of the revised Privacy Policy. Where required by law, we will provide additional notice.
